The ad appeared on Naked Wines’ website after a customer made a purchase, and said: “Thank you. Now would you like your money back?” and “Now, would you like £40 refunded to your account?”
Underneath the text were two links – a red one which stated “No thank you, I have quite enuff (sic) money already” and a green one that said: “Yes please, it would be stupid not to.”
If consumers clicked on the green link they automatically signed up to a Naked Wines angels account, into which they would invest £20 a month.
The ASA said that although this deal was explained on the site, and that anyone who signed up by mistake would be entitled to a full refund, it was not clear enough what clicking on the green link would entail.
Naked Wines changed the ad following the complaint, and the ASA ruled that it should not appear in the same format again.
