Vodkat could keep name

Intercontinental Brands may not have to change the name of its Vodkat schnapps brand after all.

The company said it would be asking retailers not to merchandise it alongside vodka to avoid confusion while a new pack design is finalised.

A court ruling two weeks ago, in a passing-off case bought by Smirnoff owner Diageo, appeared to dictate that Vodkat would have to change its name.

But at a new hearing to thrash out the detail of the decision the judge said ICB will be allowed to use the Vodkat name provided it makes it clear that it is not a vodka.

ICB director Paul Burton said: “ICB will now be taking further steps in its labelling, advertising and trade information to make it absolutely clear it is not a vodka.”?Diageo said it would be “satisfied” with any changes providing “the vodka category is not being harmed”.
